Terms & Conditions

These Terms & Conditions (“Terms”) govern your application to, and participation in, the Edinburgh Black Card™ membership programme (“Membership”, “Programme”, “we”, “us”, “our”). By submitting an application, purchasing a membership, or accessing any member benefits, you agree to be legally bound by these Terms.

We reserve the right to refuse membership at our sole discretion.

1. Membership Overview

1.1 Edinburgh Black Card™ is a private, invitation-based membership programme offering curated dining, café, and event privileges within Edinburgh.

1.2 Membership is limited in number and subject to approval.

1.3 Membership does not guarantee access to any specific venue, date, event, or experience.

1.4 All benefits are discretionary and subject to availability.

2. Application Fee

2.1 A one-off application fee is payable upon submission of your application.

2.2 If your application is declined, the application fee will be automatically refunded to your original payment method.

2.3 If your application is approved, the application fee becomes strictly non-refundable and is used to activate your membership and secure access to your first month’s privileges.

2.4 Submission of an application does not guarantee acceptance.

2.5 We reserve the right to decline any application without providing a reason.

3. Membership Fee & Billing

3.1 Membership operates on a recurring monthly subscription basis.

3.2 By subscribing, you authorise us to charge your payment method on a recurring basis unless cancelled in accordance with Section 7.

3.3 Your monthly fee provides access to:

One dining credit per month

One café credit per month

Access to member events (separate event fees may apply)

Member communications and support

3.4 Fees may be reviewed and adjusted at our discretion. Members will receive at least 14 days’ notice of pricing changes.

3.5 Failure of payment may result in suspension or termination of membership.

3.6 We reserve the right to use third-party payment processors.

4. Dining Credits

4.1 Each monthly dining credit entitles the member to a pre-set menu experience for two at a participating partner restaurant.

4.2 Dining credits:

Are valid only within the calendar month issued

Do not roll over

Have no cash value

Are non-transferable unless expressly authorised

Are subject to booking availability

Must be redeemed in accordance with partner venue availability

4.3 We reserve the right to change, rotate, suspend, or remove partner restaurants at any time without compensation.

4.4 Failure to attend a booking (“no-show”) may result in forfeiture of credits and/or suspension.

4.5 Late arrival may result in cancellation at the venue’s discretion.

5. Café Credits

5.1 Each monthly café credit entitles the member to one complimentary drink at participating cafés.

5.2 Café credits:

Are valid only in the month issued

Do not roll over

Have no monetary value

Are non-refundable and non-exchangeable

5.3 Participating cafés may change without notice.

6. Events

6.1 Events are optional and subject to availability.

6.2 Events may require separate ticket purchase.

6.3 Tickets are non-refundable except where the event is cancelled by us.

6.4 We reserve the right to change venues, schedules, or event content.

6.5 Identification matching the account holder may be required.

6.6 We reserve the right to refuse entry at our discretion.

7. Cancellation & Termination

7.1 You may cancel your membership at any time via your account dashboard or by contacting support.

7.2 Cancellation takes effect at the end of the current billing cycle.

7.3 No refunds or partial refunds are provided for unused credits or partially used billing periods.

7.4 We reserve the right to suspend or terminate membership immediately, without refund, if:

These Terms are breached

Fraud, chargeback abuse, or misuse is suspected

A member engages in abusive, inappropriate, or unlawful behaviour

A member damages the reputation of the Programme or its partners

7.5 Terminated members are not entitled to refunds of past or current fees.

8. Conduct & Misuse

8.1 Members must behave respectfully toward partner venues, staff, and other members.

8.2 Abuse of partner venues, manipulation of booking systems, credit misuse, or attempting to circumvent restrictions may result in immediate termination.

8.3 Sharing, reselling, or commercially exploiting membership privileges is strictly prohibited.

8.4 We reserve the right to recover losses incurred due to misuse.

9. Partner Venue Policies

9.1 Each partner venue’s policies apply, including dress code, conduct, cancellation windows, and booking restrictions.

9.2 Venues may refuse entry or service at their discretion.

9.3 We are not responsible for partner venue decisions, service standards, or operational changes.

10. Refund Policy

10.1 Application fee: refunded only if application is declined.

10.2 Membership fees: non-refundable once a billing cycle has commenced.

10.3 Event fees: refundable only if the event is cancelled by us.

10.4 No refunds will be issued for failure to redeem credits.

10.5 Chargebacks or payment disputes may result in immediate termination.

11. Changes to the Programme

11.1 We reserve the right to:

Modify benefits

Change partner venues

Amend credit structure

Adjust pricing

Update these Terms

11.2 Updated Terms take effect upon publication on our website.

11.3 Continued membership constitutes acceptance of revised Terms.

12. Limitation of Liability

12.1 We act as an intermediary between members and partner venues.

12.2 We are not liable for:

Venue closures

Service interruptions

Food quality

Personal dissatisfaction

Changes in availability

12.3 To the maximum extent permitted by law, our total liability shall not exceed the membership fee paid in the preceding one-month period.

12.4 Nothing in these Terms excludes liability where it cannot legally be excluded.

13. Force Majeure

We shall not be liable for failure to perform due to events beyond our reasonable control, including but not limited to government restrictions, venue closures, strikes, pandemics, or unforeseen operational disruptions.

14. Intellectual Property

All branding, trademarks, logos, and content relating to Edinburgh Black Card™ remain our exclusive property and may not be used without written permission.

15. Governing Law

These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
